Terms of Service

Terms governing use of Streamotive's website, tools and related services. Streamotive operates as a read-only API consumer of Twitch and YouTube data. Authentication and data storage are handled by Twitch and Google.

Terms of Service

By accessing or using the Streamotive website, tools, browser source overlays, dashboards, or any related service (together, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Who we are and what we do

Streamotive provides streaming tools and overlays that connect to Twitch and YouTube through their respective official public APIs. We operate as a read-only consumer of the data those APIs return. We do not independently collect, store, or manage personal data beyond what is strictly necessary to deliver the requested API response to your browser session.

Authentication on Streamotive is handled exclusively through Twitch OAuth and Google OAuth. Streamotive does not operate its own identity or credential system. We do not store your Twitch or Google passwords. Any data associated with your identity is held and governed by Twitch and Google respectively under their own privacy policies and terms of service, not by Streamotive.

2. Acceptance of terms

You must be legally capable of entering a binding agreement in your jurisdiction. By using the Service, you confirm that you are. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

3. Third-party platforms and data responsibility

3.1 Twitch

Streamotive accesses your Twitch data exclusively through the Twitch API. The data returned — including clips, channel information, follower counts and related metadata — is provided to Streamotive by Twitch and remains governed by the Twitch Terms of Service and the Twitch Privacy Policy.

Streamotive is not responsible for the accuracy, completeness, or availability of data returned by the Twitch API. Changes to Twitch's API, data structures, or access permissions may affect Service functionality at any time without notice from Streamotive.

3.2 YouTube

Where Streamotive accesses YouTube data, it does so through the YouTube Data API. That data remains subject to the Google Terms of Service and the Google Privacy Policy. YouTube API Services used by Streamotive are governed by the YouTube Terms of Service.

3.3 Authentication

Login and identity verification are performed entirely through OAuth flows operated by Twitch and Google. Streamotive receives only the access tokens and public profile information those platforms pass to us. We do not see, store, or transmit your passwords. If your Twitch or Google account is compromised, that compromise originates with those platforms, not with Streamotive.

3.4 Data not stored by Streamotive

Because Streamotive functions as a real-time API relay for most features, we do not maintain persistent databases of your followers, clips, channel statistics, or viewer data. Data is fetched on demand from the relevant platform API and returned to your session. Streamotive is not liable for any loss, inaccuracy, or unavailability of that data, as it originates with and is controlled by the respective platform.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Attempt to gain unauthorised access to any part of the Service or any system connected to it
  • Use the Service to violate the terms of Twitch, YouTube, Google, or any other integrated platform
  • Reverse engineer, decompile, or extract source code from the Service except as expressly permitted by law
  • Scrape, crawl, or automate requests to the Service in a manner that places unreasonable load on infrastructure or circumvents rate limits
  • Use the Service to transmit unlawful, harassing, defamatory, or otherwise harmful content
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate your access to the Service for any violation of these rules without prior notice.

5. Intellectual property

All intellectual property in the Service, including but not limited to the Streamotive name, logo, design, code and documentation, belongs to Streamotive or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service as it is offered. You may not copy, modify, distribute, or create derivative works from the Service or any part of it except where expressly permitted by law.

Content retrieved from Twitch or YouTube through the Service remains the property of the respective rights holders and is subject to those platforms' terms.

6. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STREAMOTIVE DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, or free of harmful components
  • Any warranty regarding the accuracy or completeness of data retrieved from Twitch, YouTube, or any other third-party API

Some jurisdictions do not permit the exclusion of implied warranties. In those jurisdictions, the above exclusions apply to the maximum extent permitted by law.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAMOTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, revenue, profits, goodwill, or business opportunities
  • Service interruptions or downtime
  • Changes to or discontinuation of Twitch API, YouTube Data API, or any other third-party API
  • Unauthorised access to or alteration of your Twitch or Google account, as those accounts are managed by Twitch and Google respectively
  • Actions or omissions of Twitch, Google, or any other third-party platform

IN NO EVENT SHALL STREAMOTIVE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO STREAMOTIVE IN THE SIX MONTHS PRECEDING THE CLAIM; OR (B) £10 GBP.

BECAUSE STREAMOTIVE OPERATES AS A READ-ONLY CONSUMER OF THIRD-PARTY APIS AND DOES NOT INDEPENDENTLY STORE YOUR PERSONAL DATA OR CREDENTIALS, THE VAST MAJORITY OF DATA-RELATED LIABILITY RESTS WITH THE RESPECTIVE PLATFORM (TWITCH OR GOOGLE) UNDER WHOSE TERMS YOUR ACCOUNT AND DATA ARE HELD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to defend, indemnify and hold harmless Streamotive, its operators, affiliates, officers and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or inability to use the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including the terms of Twitch, Google, or YouTube
  • Any content you transmit through or in connection with the Service

9. Changes to the Service and these Terms

We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, stop using the Service.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, without liability to you. On termination, all licences granted to you under these Terms immediately cease. Sections that by their nature should survive termination — including disclaimers, limitations of liability, indemnification and governing law — will survive.

11. Governing law and dispute resolution

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in a jurisdiction with mandatory local court rights, in which case those rights are unaffected.

No provision of these Terms limits your statutory rights as a consumer where applicable law does not permit such limitations.

12. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible and the remaining provisions will continue in full force and effect.

13. Entire agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Streamotive regarding the Service and supersede all prior agreements, understandings, or representations relating to it.
